1. Should I remove or relocate this because it is making contact with my heatsink?

Afaik that cap is required. You either have to relocate it, or adjust your heatsink. You could just drill a shallow 10mm wide hole in the bottom of the sink to prevent it making contact.

Be careful if your heat sink is conductive to not short anything.
